We collect information from users of our digital or mobile applications, visitors to our website or customers at our restaurants in several ways. We collect information from you logging in to our digital or mobile applications or when you complete a signup form (a) in a participating restaurant, or (b) by registering online through our website, or (c) by contact us through call center.

The type of information we collect can vary depending on where you are on our site. Typically, we collect “contact information,” such as your name and physical or email address, telephone numbers, or other ways of contacting you. For example, if you order from Zack’s, we will ask you to provide us with your contact information. We use this information to contact you.

Some places on our website may also ask you to provide additional information about you, such as the month and day of your birth Some places on our website will also give you the option to provide “demographic” information (such as your gender and zip code) to us. We encourage you to submit this information so we can provide you a more personalized service, but if you choose not to provide such demographic information, you may still use other features of our website. You may also see an opportunity to provide your cell phone number during the sign-up process, through a separate email, or by other means such as signing up via text. By providing us with your cell phone number, you are giving us permission to send you text (SMS) messages on your cell phone.

We may share your personal information within the Zack’s Group.

Members of Zack’s group who receive this information from us are not authorized to use or share the information, except as set out in this privacy statement.

We may use your personal information, such as fulfilling orders, providing data processing and other information technology services, managing promotions, contests, prize draws and sweepstakes, carrying out research and analysis, and personalizing Zack’s  customer experiences

There may be times where we may share information when it does not directly identify you.  For example, we may share anonymous, aggregated statistics about your use of our online services.  Or we may combine information about you with other customers and share the information in a way that does not link to a specific customer.

We have the right to use or share personal information as necessary to keep to any law, regulation or legal request, to protect our online services and in-restaurant technology, to bring or defend legal claims, to protect the rights, interests, safety and security of our organization, our employees or franchisees, or members of the public, or in connection with investigating fraud or other crime, or violations of our policies.

When you log into our mobile application you will be asked whether you want the mobile application to remember you (opting in). If you choose yes, the mobile application will remain logged into your information. At any time, you can choose to opt-out by choosing the logout button on the application.

From time to time we may provide you the opportunity to participate in contests or surveys. Participation in these surveys or contests is voluntary. If you participate, you will be asked to provide certain information from you such as contact information, demographic information (such as zip code) and personal preference information (such as your opinions). We use this information to better understand our customers or to administer the contest itself. You always have a choice whether or not to disclose this information, although in some cases not disclosing the information may mean that you choose not to participate in the contest or survey.

Zack’s may use a third-party service provider to conduct these surveys or contests. Where we do, that company is prohibited from using the information that you provide or any other information about you for any other purpose.

The Children’s Online Privacy Protection Act restricts the ability of commercial websites to collect and use information from children under the age of 13.

We collect information from persons interested in becoming a franchisee. We use the information that you provide in the Franchise Information portion of our site, including our own a Franchise Information web form, to contact you in connection with your interest in becoming a franchisee.

Zack’s has put in place technological and procedural security functions in order to protect the personal information it collects, uses or transfers from loss, misuse, alteration or destruction. Zack’s uses firewalls to help prevent outside parties from accessing our database server through the Internet, and physical access to the database server is restricted to authorized individuals. When transferring personally identifiable information to and from third parties Zack’s uses SSL and/or SFTP (Secure FTP)

If we make material changes to this policy, we will publicize such changes by means of a notice on our home page by providing thirty (30) days notice to you by displaying a prominent notice, in all caps, above the text of the Privacy Statement.
